Use Constraints:
National Audubon Society supports federal, state, and local agencies as well as nonprofits and other organizations in the conservation of birds, wildlife, and their habitats. For this reason, data associated with the Important Bird Areas (IBA) program and other Audubon initiatives are available to others for conservation purposes as long as the recipient acknowledges and agrees to the terms specified below. - The data provided in this release will reside on the GIS system of the recipient, and will not be copied, distributed, or made accessible to other individuals. Requests by others will be referred directly to Audubon. - The data provided in this release will not be used by the recipient for any other projects or analyses than those identified above. Requests to use the data in any other way should be made to Audubon. - The IBA boundaries and boundaries of other priority areas should not be perceived as absolute, definite boundaries. Rather, the boundaries should be considered approximates of the critical habitat areas. - Use and analysis of geographic data are limited by the scale at which the data are collected and mapped. - Comprehensive site specific surveys have not been conducted for each IBA, therefore, the data provided in this release cannot be relied on as a definitive statement of the presence or absence of all species at a given location. - These data should not be considered a substitute for on-site surveys that may be required for an environmental assessment, environmental impact statement, or conservation planning. - The information and data associated with the boundaries are continually growing as new data are acquired. Therefore, the data released may become outdated. IBA/conservation data are provided to you on a one-time basis. Any subsequent requests for data or any updates to these data must be submitted as a new request and will require agreement to these or updated terms at the time of request. - The point locations of IBA can be shown publicly, however, the geographic boundaries (i.e., the polygon boundaries) cannot and should only be used for internal purposes (i.e., by the applicant identified in "Applicants Name"). - Exceptions may be made to allow for public display of boundaries, based on the nature of the project but must be by specific agreement with Audubon. If this is the case, the recipient will agree to provide Audubon access to reports, publications, or web content where these geographic boundaries are displaying. - Recipient agrees to share with National Audubon Society results of any analyses using IBA/conservation data, including GIS exports (jpg, pdf, map services), spatial data associated with the export in a geodatabase, and a map package of all the exports. - Any publications or reports that reference data provided in this release will cite the data using the following format: National Audubon Society. [Date]. Important Bird Areas Database, Boundary Digital Data Set. Any display of point locations of IBAs online should be accompanied by attribution to the National Audubon Society. Data for other conservation priorities should be cited similarly. - You acknowledge that Audubon is the sole owner of the digital boundary data set and that there is no transfer of ownership by virtue of this agreement. Contact iba@audubon.org if you have questions regarding these data or terms.
